FGPC Boat Rental Terms & Conditions Agreement

(Outrigger OC6 and Small Craft)

1. Agreement Overview

This agreement governs the rental and use of watercraft owned or managed by the Fairway Gorge Paddling Club (FGPC). By renting or using FGPC equipment, the renter acknowledges and agrees to all terms outlined herein.

2. Definition of Renter

The “Renter” is defined as:

The individual signing this agreement; and
Any affiliated team, crew, or organization using the equipment under that individual’s authorization

The Renter assumes full responsibility for all users of the equipment during the rental period.

3. Equipment Covered

This agreement applies to all FGPC watercraft, including but not limited to:

OC6 canoes
OC1 / V1 / OC2 canoes
Dragon boats or other small craft
Associated equipment (iaku, ama, paddles, covers, dollies, etc.)

4. Core Responsibility for Damage

The Renter is fully responsible for the condition of the equipment from the time of pickup until its return.

This includes:

All damage, whether caused by:
Collision
Improper rigging
Transport incidents
Environmental conditions (wind, waves, grounding, etc.)
Negligence or misuse
Actions of any crew member or third party

Financial responsibility:

Full cost of repair, including labor and materials
Full replacement cost if the equipment is deemed irreparable
Any associated shipping, sourcing, or downtime costs where applicable

This responsibility applies regardless of fault or intent.

5. Pre-Use Inspection

Equipment will be provided in good working condition unless otherwise noted
The Renter is expected to inspect the equipment prior to use
Any pre-existing damage must be reported immediately before use
Failure to report pre-existing damage constitutes acceptance of equipment condition

6. Use of Equipment

The Renter agrees to:

Use equipment only for its intended purpose (paddling/racing)
Ensure all users are competent and appropriately trained
Comply with all applicable marine safety regulations
Avoid use in unsafe or extreme conditions
Ensure proper rigging (including correct ama and iaku configuration)
Prevent dragging, improper loading, or avoidable wear

FGPC reserves the right to deny rental based on safety concerns.

7. Transport and Storage

If equipment is transported offsite:

The Renter assumes full responsibility during transport
Proper racks, tie-downs, and padding must be used
Any transport-related damage is the sole responsibility of the Renter

Storage during the rental period must:

Prevent exposure to unnecessary risk
Avoid theft, vandalism, or environmental damage

8. Race Use

If equipment is used in competition:

The Renter assumes all risks associated with race conditions
Damage incurred during racing is fully the responsibility of the Renter
No exceptions are made for race-related incidents

9. Reporting Damage

Any damage must be reported to FGPC immediately
Continued use of damaged equipment is prohibited unless explicitly approved
Failure to report damage may result in additional penalties or suspension of rental privileges

10. Repair Process

FGPC retains sole discretion over repair decisions
Repairs may be conducted by FGPC or designated specialists
The Renter agrees to pay all invoiced repair or replacement costs

11. Insurance

FGPC insurance (if any) does not cover renter-caused damage
The Renter is encouraged to obtain independent insurance if desired
Lack of insurance does not reduce financial responsibility

12. Liability Waiver

The Renter acknowledges that paddling and water sports involve inherent risks.

The Renter agrees:

To assume all risks associated with use of the equipment
To release FGPC from liability for injury, loss, or damage arising from use
To ensure all crew members are aware of and accept these risks

13. Indemnification

The Renter agrees to indemnify and hold harmless FGPC from any claims, damages, or legal actions arising from:

Use or misuse of the equipment
Actions of the Renter or their crew
Failure to comply with this agreement

14. Payment Terms

Rental fees are separate from damage costs
Damage/repair invoices are payable within 30 days

FGPC reserves the right to:

Withhold future rentals
Pursue recovery of unpaid costs

15. Cancellation / Revocation

FGPC reserves the right to:

Cancel or terminate rentals at its discretion
Revoke rental privileges for non-compliance

16. Acceptance of Terms

The Renter confirms:

They have read and understood this agreement
They accept full financial responsibility for any damage or loss
They are authorized to bind their crew/team to these terms

Security / Deposit Clause

FGPC may require a damage deposit or hold a credit card on file. This does not limit the Renter’s liability, which may exceed the deposit amount.
